From Rules to Results: CFE Issues Joint Statement on 6 Priorities for Effective EU AML Implementation

A joint call for effective AML implementation

CFE Tax Advisers Europe has issued a joint statement with Accountancy Europe, the European Tax Adviser Federation (ETAF) and the Council of Bars and Law Societies of Europe (CCBE). The organisations support the EU goal of preventing money laundering and terrorist financing. They call for the Single Rulebook to be implemented in a proportionate and risk-based way.

They warn that ever more granular requirements on data, documentation and processes may produce a paper trail rather than better detection of financial crime. The statement builds on CFE's engagement with the EU Anti-Money Laundering Authority (AMLA), including its submissions on draft technical standards.

Six priorities

First, data collection should be purposeful: more data does not automatically mean better AML. Second, proportionality must work in practice for SMEs and sole practitioners, who lack the compliance departments of large institutions. Third, rules should be sector-specific, since accountants, auditors, lawyers and tax advisers do not hold client accounts or process payments like banks, and AMLA should develop non-financial sector expertise.

Fourth, requirements must be legally and operationally feasible, notably group-wide rules for networks of legally independent firms, with realistic implementation periods. Fifth, professional judgement should be preserved rather than replaced by box-ticking. Sixth, the risk-based approach should determine the substance of obligations rather than sit alongside prescriptive processes.

Next steps

The signatories stress that this is not a call to lower AML standards. They urge AMLA and the European Commission to check whether the draft technical standards deliver real effectiveness and to amend them before they become embedded. CFE will continue engaging with both institutions.
