Accertamenti da indagini finanziarie: la stretta della Cassazione. Documentazione "inutilizzabile" se non autorizzata (Ord. n. 19956 del 15 giugno 2026)
Con l'Ordinanza n. 19956 del 15 giugno 2026 la Corte di Cassazione, Sezione Quinta, stabilisce che l'autorizzazione alle indagini bancarie (art. 32, c. 1 n. 7 DPR 600/1973 e art. 51, c. 2 n. 7 DPR 633/1972), pur restando atto interno e preparatorio, deve preesistere alle indagini e avere un contenuto minimo verificabile alla luce dell'art. 8 CEDU: in difetto, la documentazione bancaria è inutilizzabile e l'avviso di accertamento è invalido. Intelligenza artificiale e attuazione dei tributi: la relazione dell'A.N.T.I. alla Commissione parlamentare di vigilanza sull'Anagrafe tributaria
Il 7 giugno 2026 l'A.N.T.I. ha depositato la propria relazione nell'ambito dell'indagine conoscitiva su misure di contrasto all'evasione fiscale, sicurezza delle banche dati dell'Anagrafe tributaria e tutela della riservatezza dei dati dei contribuenti. Il documento analizza le criticità connesse all'impiego di sistemi di intelligenza artificiale nella fase di attuazione dei tributi e propone alcune ipotesi di regolazione a tutela sia dell'interesse pubblico alla corretta attuazione dei tributi sia dei diritti individuali dei contribuenti.
